These Terms and conditions (the “Terms”) govern your use of the Playa Cars website (the “Site”, “Playa Cars”, “we”). By using the Site you accept these Terms and our Privacy notice. If you do not agree, do not use the Site.
What Playa Cars is
- Playa Cars is an independent search engine and directory of cars for sale at dealers and car lots in Quintana Roo, Mexico. It gathers in one place information that dealers publish on their own websites.
- Playa Cars is not a dealer, seller, agent or broker. It does not own, inspect or certify the vehicles, does not take payments or deposits, and is not involved in the negotiation, sale, financing, delivery or warranty of any vehicle.
- Any transaction is made solely between you and the dealer or seller, under their own terms.
- The appearance of a dealer or vehicle on the Site does not imply any business relationship, sponsorship, endorsement or verification by Playa Cars.
Listing information
- Listings (price, year, trim, mileage, photos, location, availability and contact details) are collected automatically from dealers’ public web pages and refreshed periodically, not in real time. They may contain errors or omissions or be out of date, including cars already sold or with a different price.
- Prices are shown in Mexican pesos (MXN) as published by the dealer, are for information only and are not an offer by Playa Cars. They may exclude taxes, fees, paperwork, plates, annual vehicle tax, insurance and other charges. Only the price, terms and availability the dealer confirms to you in writing are valid.
- Photos and descriptions come from the dealer; they may be illustrative or not match the vehicle exactly.
- “Below median”, the market comparison, price history, days listed and statistics are automatic calculations based only on listings collected by Playa Cars. They are not an appraisal, a valuation or a recommendation to buy.
- “Sold” means the listing was withdrawn or marked as sold according to the dealer’s information; it does not confirm that a sale took place or its terms.
Before you buy
We recommend that you:
- See the car in person and, ideally, have a mechanic you trust inspect it.
- Check the VIN (NIV) and confirm the vehicle has no theft report in REPUVE, Mexico’s public vehicle registry.
- Review the original invoice (factura) and its chain of endorsements, paid vehicle taxes, emissions checks and, for foreign-origin cars, the import document (pedimento).
- Confirm price, warranty and terms in writing before paying. Never send a deposit before seeing the car and its paperwork, and be wary of prices far below the market.
- Playa Cars will never ask you for payments, deposits or bank details.
Contacting dealers and third-party sites
The WhatsApp, Call, View listing and Website buttons connect you directly with the dealer or take you to third-party services (such as WhatsApp). Playa Cars does not receive or store those conversations and is not responsible for the content, privacy practices or conduct of those third parties, whose own terms apply.
Acceptable use
When using the Site you agree not to:
- use it for unlawful or fraudulent purposes or to deceive others;
- extract or copy its content or database in bulk or by automated means, or use its API to replicate the Site or build a competing service, without written permission;
- interfere with its operation, overload it or try to access non-public systems or data;
- impersonate Playa Cars or a dealer.
We may limit or block access for anyone who breaches these Terms.
Intellectual property and trademarks
- The design, code, selection and arrangement of the information, the calculations and the Playa Cars brand belong to us or are used with permission.
- Manufacturer and dealer trademarks, model names, logos and trade names belong to their respective owners and are mentioned only to identify the vehicles and who offers them. Playa Cars is not affiliated with or sponsored by any manufacturer.
- Listing photos and text belong to the dealer or their owners and are shown as published, with a link to the original listing.
Dealers: correcting and removing listings
- Listings mirror what each dealer publishes on its own website. When a dealer corrects a detail, marks a car as sold or removes a listing or its photos on its site, the change shows on Playa Cars at the next update.
- Playa Cars may correct, hide or remove any listing, photo or dealer information at any time.
Disclaimer of warranties
The Site is provided “as is” and “as available”. To the extent permitted by law, Playa Cars does not warrant the accuracy, completeness or currency of the information; the existence, condition, origin, paperwork or availability of the vehicles; the conduct, solvency or performance of dealers; or that the Site will be uninterrupted or error-free.
Limitation of liability
To the fullest extent permitted by applicable law, Playa Cars and those who operate it will not be liable for any damage or loss arising from: the use of or inability to use the Site; decisions made based on its information; the purchase, sale, financing, condition, paperwork, origin or warranty of a vehicle; or the acts or omissions of dealers or third parties.
Nothing in these Terms limits any rights you have under Mexico’s Federal Consumer Protection Law (Ley Federal de Protección al Consumidor) or other provisions that cannot be waived.
Indemnity
You agree to hold Playa Cars harmless from any third-party claim arising from your misuse of the Site or breach of these Terms.
Changes
We may change, suspend or discontinue the Site or any of its features, and update these Terms at any time. The version in force is the one published on this page with its update date; continuing to use the Site after a change means you accept it.
Governing law and jurisdiction
These Terms are governed by the federal laws of the United Mexican States. For any dispute, the parties submit to the competent courts of Quintana Roo, Mexico, waiving any other jurisdiction that may apply by reason of their present or future domicile, without prejudice to consumers’ rights before the Federal Consumer Protection Agency (PROFECO).
Language
The Spanish version of these Terms prevails over any translation.
